A sizeable body of literature suggests that informal methods of dispute resolution — and, in particular, conciliation — flourish only in societies marked by extensive social hierarchy. Given this literature, it is quite surprising to discover that in the mid-nineteenth century, the United States embarked on an extensive debate regarding whether to adopt "conciliation courts," whose primary function was to reconcile the disputants by persuading them to embrace an equitable compromise. First created by the French Revolutionaries in 1790, conciliation courts (...) were widely established throughout continental Europe. Observing this development, leading American lawyers and politicians pondered seriously whether the United states ought to follow suit. Debate over whether to embrace such institutions occurred at the very highest of levels, and a series of states enacted constitutional provisions authorizing their legislatures to create conciliation courts. Ultimately, however, despite the widespread interest in such institutions, these were never established — except in the notable case of the Freedmen’s Bureau courts of the Reconstruction South. This Article explores this largely forgotten episode in American legal history. It examines why a nation that was radically egalitarian by standards of the time would seriously consider embracing an institution that we tend more commonly to associate with inegalitarian, strongly hierarchical societies — and why, after coming so close to adopting conciliation courts, it ultimately failed to do so. In the process, by situating the debate over conciliation courts in a broader social and legal context, the Article also excavates the origins of the modern, quintessentially American commitment to the virtues of formal, adversarial process. Medical aid in dying (MAiD), despite being legal in many jurisdictions, remains controversial ethically. Existing surveys of physicians’ perceptions of MAiD tend to focus on the legal or moral permissibility of MAiD in general. Using a novel sampling strategy, we surveyed physicians likely to have engaged in MAiD-related activities in Colorado to assess their attitudes toward contemporary ethical issues in MAiD.

Keystream sequences should look as random as possible, i.e. should present no logical pattern to be exploited in cryptographic attacks. The generalized self-shrinking generator, a sequence generator based on irregular decimation, produces a family of sequences with good cryptographic properties. In this work, we display a detailed analysis on the randomness of the sequences resulting from the concatenation of elements of this family. Il tema della retorica, come una delle dimensioni possibili in cui rappresentare la storia, dà vita sia a una peculiare narrazione _descrittiva_ del Medioevo, plurale e variegata, sia a una narrazione _creatrice_ della storia stessa, dal momento che la potenza della parola di Agostino viene colta nella sua capacità (...) di incidere e trasformare la storia stessa. Il contributo si conclude con l’analisi di alcuni tratti salienti di altri romanzi di ambientazione medievale di De Wohl, su Francesco d’Assisi e su Tommaso d’Aquino, per osservarne la peculiare rappresentazione di Medioevo che a tratti sembra andare oltre agli schemi storiografici degli anni in cui sono scritti. _The article intends to explore the question of the Middle Ages as a place of narrations starting from Louis De Wohl’s novel about Augustine of Hippo, _The Restless Flame_ and the theme of rhetoric. The subject of rhetoric, as one of the possible dimensions in which to represent history, gives rise both to a peculiar _descriptive_ narrative of the Middle Ages, plural and variegated, and to a narration that _creates_ history itself, since the power of Augustine’s word is captured in its ability to affect and transform history itself. The paper concludes with an analysis of some salient features of other medieval novels by De Wohl, on Francis of Assisi and Thomas Aquinas, in order to observe the peculiar representation of the Middle Ages that emerges, which at times seems to go beyond the historiographic schemes of the years in which they were written_. Negli studi sul pensiero medievale la questione delle filosofie francescane si presenta come controversa a proposito della definizione di una essenza del pensiero francescano – in relazione alla figura di Francesco d’Assisi –, di temi di riflessione specifici e del rapporto con le tradizioni filosofiche precedenti.Si tratta di un francescanesimo controverso pure all’interno di una stessa tradizione storiografica, come quella Neoscolastica, in cui studiosi come Gilson, Vignaux e Boehner ne hanno sottolineato il carattere prevalentemente agostiniano o aristotelico.Partendo dalla consapevolezza della (...) problematicità della questione, il saggio si sofferma sui possibili caratteri comuni delle teorie della conoscenza in alcuni pensatori francescani tra XIII e XIV secolo, come Pietro Giovanni Olivi e Pietro Aureolo, a partire dai concetti di conversio, intentio e reflexio e dal loro rapporto con la tradizione agostiniana.Si delineano così teorie della conoscenza che privilegiano l’attività e l’immediatezza del conoscere, sia per la conoscenza diretta sia per quella riflessa.Infine, tali caratteri si possono cogliere pure in un autore non francescano ma secolare come Nicola di Autrecourt, la cui teoria della conoscenza ha fatto parlare di un internalismo vicino a quello delle correnti francescane del XIV secolo. In conclusione, se da una parte non si può ipostatizzare l’idea di caratteri comuni del pensiero francescano, dall’altra si può forse parlare di un comune universo discorsivo in cui la figura di Francesco d’Assisi mostra la propria portata filosofica nella storia. In the History of Medieval Philosophy’s studies, the question of Franciscan philosophies has been the subject of controversy concerning the definition of an essence of Franciscan thought, about the relationship with Francesco d’Assisi, of specific topics of reflection and relationship with the previous philosophical traditions.It is a controversial Franciscanism even within the same historiographical tradition, such as the Neo-Scholastic one, in which scholars such as Gilson, Vignaux and Boehner have emphasised its predominantly Augustinian or Aristotelian character.Starting from the awareness of the problematic nature of the issue, the essay focuses on the possible common peculiarities of the theories of knowledge in some Franciscan thinkers between the 13th and 14th centuries, such as Pietro Giovanni Olivi and Pietro Aureolo, starting from the concepts of conversio, intentio, reflexio and their relationship with the Augustinian tradition.Thus the theories of knowledge are delineated which privilege the activity and the immediacy of knowing, both for direct and reflected knowledge.Finally, these features can also be grasped in a non-Franciscan but secular author like Nicola di Autrecourt, whose theory of knowledge has made mention of a type of internalism close to that of the 14th century Franciscan movement. Therefore, in conclusion, while on the one hand the idea of common particularities of Franciscan thought can not be hypostatised, on the other hand we can perhaps speak of a common discursive universe in which the figure of Francesco d’Assisi shows his philosophical significance in history. Don et réciprocité : anathemata phrygiens et lydiens dans les sanctuaires grecs Au vu des témoignages archéologiques et des attestations de sources littéraires, on peut considérer que, dans la société ancienne, l’offrande aux dieux et la sacralité en général était une manière de fonder des liens sociaux, et ce par l’établissement de la réciprocité des faveurs. En Grèce ancienne, l’espace religieux, en tant qu’inclusif et partiellement ouvert aux étrangers, joue de toute évidence un rôle déterminant dans les relations entre Grecs (...) et Barbares, ainsi que l’offrande aux dieux, susceptible de créer des relations sociales, interculturelles et politiques. Les grands sanctuaires grecs ont livré de nombreux et célèbres anathemata, présents d’étrangers ou de collectivités de citoyens grecs. Dans cet article sont examinées certaines offrandes effectuées dans les sanctuaires internationaux helléniques par les Barbares de l’arrière-pays anatolien, Phrygiens et Lydiens, qui établirent des relations avec les cités grecques fondées sur la côte de l’Asie Mineure. Seule esthétique générale de Nietzsche publiée en français, cette synthèse thématique met en lumière ses multiples évolutions, jusqu'à présent difficilement saisissables. La démarche est pédagogique et didactique afin de permettre au lecteur d'effectuer par lui-même le bilan des principaux acquis de cette recherche. Fondé sur l'examen exhaustif des écrits philosophiques de Nietzsche, le traitement informatique des fragments posthumes a notamment permis d'apporter une vision plus précise et systématique de ces transformations et de leurs enjeux philosophiques. Ainsi les figures d'Apollon et (...) de Dionysos ont évolué dans le sens d'un devenir apollinien de Dionysos. Les notions de rêve et d'ivresse se sont modifiées dans le sens d'une dissolution de leur antagonisme. Le statut accordé par Nietzsche à la musique et aux arts plastiques s'est transformé dans le sens d'une prééminence du modèle plastique sur le modèle musical à partir de sa rupture avec Wagner. Une esthétique classique fondée sur la valeur vitale de la belle illusion et du mensonge optimiste s'est substituée à une esthétique négative, c'est-à-dire une esthétique du sublime et de la dissonance exprimant le pessimisme philosophique. Enfin, le classicisme très singulier de Nietzsche fait l'objet d'une définition qui rectifie certaines théories actuellement fort répandues et néanmoins erronées (on y oppose en particulier la notion de formalisme classique à celle d'hyperclassicisme). Cette esthétique défend une approche humaniste de l'art compris comme une sagesse récusant simultanément la religiosité et le cynisme. Nietzsche peut être considéré comme le plus français des philosophes allemands. Son école du style, dont il se déclare le premier Allemand à faire un problème sérieux, se trouve en France et remonte au XVIe siècle. De plus, sa critique de la métaphysique est liée à celle de la langue allemande qui se prête plus aisément à la fabrication de néologismes. Ainsi, la traduction des œuvres de Nietzsche en français fournit la tentation de livrer immédiatement dans la langue de traduction (...) le fonds original de sa pensée, quitte à prendre quelques libertés envers la langue vernaculaire de l'auteur. Dès lors, se trouve posé le problème de l'invention d'un style littéraire en philosophie, destiné à relever la métaphysique de son empire sur la philosophie.. On peut distinguer deux principales écoles de traduction des œuvres philosophiques de Nietzsche en français. Chacune, avec des stratégies tantôt littéraire et tantôt philosophique, semble avoir réussi le pari d'un « transfert culturel » bien plus que d'une simple traduction de Nietzsche en français. Cette double tradition est encore vivante aujourd'hui Nietzsche can be considered as the most French among German philosophers. His school of style, which he states himself as the first German to tackle philosophically and seriously on, can be found in France and goes back to the XVI century. Besides, his criticism of metaphysics is linked with that of the German language which indeed is far more easily to be linked with building neologisms. The translation in French of Nietzsche's works always provides a temptation to deliver immediately into the translation language the original basic thought, thus running the risk to take quite a few liberties towards the author's vernacular language. Hence the problem of an invention of a literary style in philosophy becomes set, intended as it is to relieve metaphysics from its influence over philosophy. One may distinguish two major schools for the French translations of Nietzsche's philosophical works. Each one them having different strategies, now more philosophical, now more literary, yet seeming to be succesful in the challenge of a « cultural transference » far more than in a mere translation of Nietzsche into French. The socioeconomic and ethnic characteristics of parents are some of the most important correlates of adverse health outcomes in childhood. However, the relationships between ethnic, economic, and behavioral factors and the health outcomes responsible for this pervasive finding have not been specified in child health epidemiology. The general objective of this paper is to propose a theoretical approach to the study of maternal behaviors and child health in diverse ethnic and socioeconomic environments. The specific aims are: (a) to describe a (...) causal pathway between the utility that women obtain through work outside the home and through child care and disease hazard rates in childhood using an optimization model; (b) to specify the influence of ethnic and socioeconomic factors on model constraints; (c) to use the model as a tool to learn about how different combinations of maternal wage labor and child care time might influence child health outcomes in diverse social contexts; (d) to identify parameters that will require measurement in future research; (e) to discuss research strategies that will enable us to obtain these measurements; and (f) to discuss the implications of the model for biostatistical modeling and public health intervention. Optimization models are powerful heuristic tools for understanding how ethnic, environmental, family, and personal characteristics can place important constraints on both the quality and quantity of care that women can provide to their children. They provide a quantitative appreciation for the difficult trade-offs that most women face between working in order to purchase basic goods that children cannot do without (e.g., food, clothing, shelter, health insurance), and increasing offspring well-being through child care (e.g., training in social skills, affection, protection from environmental hazards, help with homework). Der Band verzeichnet erstmals sämtliche Werke und Noten aus Nietzsches persönlicher Bibliothek (BN) bis Anfang Januar 1889. Er listet sowohl die Bestände der Herzogin Anna Amalia Bibliothek als auch die des Goethe- und Schiller-Archivs in Weimar auf. Die kritische Analyse anderer Bestandslisten ermittelte zudem zahlreiche heute nicht mehr vorhandene Titel. Ferner wurden sämtliche Bücherrechnungen und -quittungen von Buchhändlern und Buchbindern ausgewertet, die im Goethe- und Schiller-Archiv aufbewahrt werden. Neben den ca. 2.200 Titeln aus Nietzsches rekonstruierter Bibliothek enthält der Band (...) auch ein Verzeichnis sämtlicher 'Lesespuren' Nietzsches (ca. 20.000), z.B. Anmerkungen, Unterstreichungen und Eselsohren. Ergänzt durch zahlreiche Faksimile-Reproduktionen sowie durch philosophische, historische und bibliographische Einführungen, stellt der Band ein unverzichtbares Arbeitsinstrument jeder zukünftigen Nietzsche-Forschung dar. This book presents a comprehensive overview of what the criminal law would look like if organised around the principle that those who deserve punishment should receive punishment commensurate with, but no greater than, that which they deserve. Larry Alexander and Kimberly Kessler Ferzan argue that desert is a function of the actor's culpability, and that culpability is a function of the risks of harm to protected interests that the actor believes he is imposing and his reasons for acting in (...) the face of those risks. The authors deny that resultant harms, as well as unperceived risks, affect the actor's desert. They thus reject punishment for inadvertent negligence as well as for intentions or preparatory acts that are not risky. Jahrhunderts gepragt.Flechtheim schrieb uber Kardinalprobleme seiner Zeit: Krieg und Frieden, Demokratie und Diktatur, Faschismus und Antifaschismus, Kommunismus und Nord-Sud-Konflikt. Er war ein Wegbereiter des Faches Politische Wissenschaft in Deutschland und befasste sich schon fruh mit dem Verhaltnis von Okonomie und Okologie.

It is becoming increasingly clear that repetitive DNA is of biological significance as well as experimental importance. Here we review the information available about one type of repetitive DNA, the trinucleotide repeat (CAC)n, and briefly compare it with other trinucleotide repeats. Although much work has been done in analysing DNA fingerprinting patterns produced using the synthetic oligonucleotide (CAC)5 as a probe, there is relatively little information about individual (CAC)n‐containing sequences and their abundance, organisation and distribution in mammalian DNA. From the (...) data that is available, it is clear that there are at least two areas that should repay further study: (1) the organisation and generation of long sequences that contain (CAC)n motifs as part of a larger repeating unit (minisatellites) and (2) the distribution of small (CAC)n sequences (microsatellites), in particular their relationship to genes. Companies that are serious about corporate governance and business ethics are turning their attention to gender diversity at the most senior levels of business . Board gender diversity has been the subject of several studies carried out by international organizations such as Catalyst , the World Economic Forum , and the European Board Diversity Analysis . They all lead to reports confirming the overall relatively low proportion of women on boards and the slow pace at which more women are being (...) appointed. Furthermore, the proportion of women on corporate boards varies much across countries. Based on institutional theory, this study hypothesizes and tests whether this variation can be attributed to differences in cultural settings across countries. Our analysis of the representation of women on boards for 32 countries during 2010 reveals that two cultural characteristics are indeed associated with the observed differences. We use the cultural dimensions proposed by Hofstede to measure this construct. Results show that countries which have the greatest tolerance for inequalities in the distribution of power and those that tend to value the role of men generally exhibit lower representations of women on boards. This piece of work intends to shed light on Alexander of Aphrodisias from the second-century Aristotle commentator through the history of Aristotelian psychology up to the sixteenth century's clandestine prompter of the new philosophy of nature. In the millennium after his death the head of the Peripatetic school in Athens served as the authority on Aristotle in the Neo-Platonic school, survived the Arabic centuries of philosophy as Averroes' exemplary exponent of the mortality of the soul and as such was not (...) considered worthy of translation by the Latin Scholastics. This attitude changed only in the Late Middle Ages, when the resistance against Averroes grew fierce and Alexander emerged as the only Aristotelian alternative to him. In 1495 his account of Aristotle's psychology was translated and published and the underlying principles of a natural philosophy, based on sense perception and exempt from metaphysics, became accessible. The prompt reception and widespread endorsement of Alexander's teaching testify to his impact throughout the sixteenth century. (shrink)

The first studies that sought to establish two-way communication between humans and great apes led to important findings but were nevertheless heavily criticized for their training methods, testing procedures, and claims. More recently, hundreds of pet owners around the world have begun training domesticated animals to use Augmentative Interspecies Communication (AIC) soundboard devices, contributing to the first ever large-scale study on interspecies communication. Here, we introduce our scientific approach to our global citizen science project, where we will investigate how dogs (...) and cats use AIC devices, building an incremental research program starting from their associative learning of buttons to determining how AIC device use might impact their welfare and their capacity for symbolic representation. We discuss how our multi-faceted approach can alleviate many of the concerns regarding the original studies performed with apes, achieving larger sample sizes, ample documentation of training techniques, and testing animals’ performance in controlled experimental settings. This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. Der in der Ukraine geborene Forscher und Universitatslehrer wirkte in Deutschland, der Schweiz und den USA. Sein Leben wurde durch die Bruche und Katastrophen des 20. Jahrhunderts gepragt.Flechtheim schrieb uber Kardinalprobleme seiner Zeit: Krieg und Frieden, Demokratie und Diktatur, Faschismus und Antifaschismus, Kommunismus und Nord-Sud-Konflikt. Er war ein Wegbereiter des Faches Politische Wissenschaft in Deutschland und befasste sich schon fruh mit dem Verhaltnis von Okonomie und Okologie.

O presente artigo apresenta um relato de experiência das ações extensionistas promovidas no ano de 2021 pelo Núcleo de Estudos Afro-brasileiros e Indígenas (NEABI) do Campus Ibirama da Instituto Federal Catarinense. Devido ao contexto de pandemia de COVID-19, que perdurou durante quase todo o ano letivo de 2021, as atividades do Núcleo precisaram ser adaptadas para que ocorressem em ambientes virtuais. Apesar desta adequação forçada, que limitou em grande medida a diversidade das ações, foi possível identificar tanto o promissor potencial (...) do NEABI quanto os desafios a serem superados para que a temática étnico-racial seja definitivamente incluída nos espaços institucionais e passe a fazer parte do cotidiano da comunidade escolar. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

This paper argues for a coherentist theory of the justification of evidentiary judgments in law, according to which a hypothesis about the events being litigated is justified if and only if it is such that an epistemically responsible fact-finder might have accepted it as justified by virtue of its coherence in like circumstances. It claims that this version of coherentism has the resources to address a main problem facing coherence theories of evidence and legal proof, namely, the problem of the (...) coherence bias. The paper then develops an aretaic approach to the standards of epistemic responsibility which govern legal fact-finding. It concludes by exploring some implications of the proposed account of the justification of evidentiary judgments in law for the epistemology of legal proof. (shrink)
